Delaware Child Support Guidelines

Every child is entitled to financial support until he or she graduates from high school or turns 19 (whichever comes first). This right does not terminate when parents divorce. In most situations, one parent will be ordered to pay child support to the other parent. The child support paid will be based in part on the custodial arrangement.

Child support is calculated using a formula that takes into account the income of both parties and the number of children being supported. However, adjustments may need to be made based on of the following factors:

  • Is the parent who is ordered to pay support also providing medical insurance coverage?
  • What are child care expenses?
  • What are the earning capacities of both parties (is a parent working substantially fewer hours just so that they don't have to pay as much support)?
  • What was the standard of living when the parents lived together
  • Are other dependant children being supported?
  • What percentage of time is spent in parenting time/visitation?
